       Senator Pizzo moved the following:
       
    1         Senate Amendment (with title amendment)

    3         Between lines 158 and 159
    4  insert:
    5         Section 4. Effective upon becoming a law, section 99.0211,
    6  Florida Statutes, is created to read:
    7         99.0211 Challenging candidacy.—
    8         (1)A person who becomes a candidate must ensure that he or
    9  she will satisfy all statutory and constitutional qualifications
   10  for the office for which he or she is seeking nomination or
   11  election.
   12         (2)A candidate or a political party with a candidate in
   13  the same race may challenge a candidate’s compliance with
   14  subsection (1) by filing an action for declaratory and
   15  injunctive relief in the circuit court for the county in which
   16  the filing officer is headquartered.
   17         (3)A person may not be qualified as a candidate for
   18  nomination or election, and his or her name may not appear on
   19  the ballot, if, in an order that has become final, the court
   20  determines that the candidate will not, at the time of
   21  qualification or election, as applicable, satisfy all statutory
   22  and constitutional qualifications for the office for which he or
   23  she is seeking nomination or election.
   24         (4)A candidate or political party bringing an action for
   25  declaratory and injunctive relief under subsection (2) is
   26  entitled to an expedited final hearing, and any appeal of a
   27  final hearing shall receive expedited consideration by the
   28  appellate court. Upon a final order of the circuit court which
   29  contains the determination under subsection (3), the supervisor
   30  of elections in each county affected by such candidacy shall
   31  remove the name of the candidate from the ballot, or if the
   32  ballots have already been printed, include a notice with each
   33  vote-by-mail ballot, and post a notice at each early voting
   34  location and polling precinct, stating that a vote for such
   35  candidate will not be counted.
   36         Section 5. Effective upon becoming a law, present
   37  subsections (2) and (3) of section 104.011, Florida Statutes,
   38  are redesignated as subsections (3) and (4), respectively, and a
   39  new subsection (2) is added to that section, to read:
   40         104.011 False swearing; submission of false voter
   41  registration information; prosecution prohibited.—
   42         (2) A person who willfully submits false information in
   43  connection with s. 99.021 or s. 99.061(7) commits a felony of
   44  the third degree, punishable as provided in s. 775.082, s.
   45  775.083, or s. 775.084.

   58         a certain determination; providing that candidates and
   59         political parties challenging compliance are entitled
   60         to expedited proceedings; requiring supervisors of
   61         elections to remove the names of certain candidates
   62         from the ballot and provide a certain notice to
   63         voters; amending s. 104.011, F.S.; providing criminal
   64         penalties for a person who willfully submits false
   65         information in connection with specified provisions;
   66         reenacting s. 99.012(1)(b), F.S., relating to
