1 A bill to be entitled
2 An act relating to electronic signatures associated
3 with total loss vehicles and vessels; amending s.
4 319.30, F.S.; requiring insurance companies to
5 implement certain control processes and procedures for
6 certain electronic signatures; deleting a requirement
7 that electronic signatures on odometer disclosures
8 submitted through insurance companies be executed in a
9 specified manner; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Paragraph (d) of subsection (3) of section
14 319.30, Florida Statutes, is amended to read:
15 319.30 Definitions; dismantling, destruction, change of
16 identity of motor vehicle, vessel, or mobile home; salvage.—
17 (3)
18 (d) An electronic signature that is consistent with chapter
19 668 satisfies any signature required under this subsection.
20 However, insurance companies must implement control processes
21 and procedures acceptable to the department to ensure adequate
22 identity verification and preservation, disposition, integrity,
23 security, confidentiality, and auditability of electronic
24 signatures, except that an electronic signature on an odometer
25 disclosure submitted through an insurance company must be
26 executed using an electronic signature, as defined in s.
27 668.003(4), which uses a system providing an Identity Assurance
28 Level, Authenticator Assurance Level, and Federation Assurance
29 Level, as described in the National Institute of Standards and
30 Technology Special Publication 800-63-3, as of December 1, 2017,
31 which are equivalent to or greater than Level 2, for each level,
32 for a certificate of destruction or for a salvage certificate of
33 title.
34 Section 2. This act shall take effect July 1, 2026.
