Health Information Systems Council; legislative intent; creation, appointment, duties.—
The Legislature finds that it is in the state’s interest to create a council consisting of executive-level managers for the state’s health-related entities, to facilitate the sharing and coordination of health-related data.
There is created a Health Information Systems Council in the Department of Health to facilitate the identification, collection, standardization, sharing, and coordination of health-related data, including fraud and abuse data, and professional and facility licensing data among federal, state, local, and private entities. The Department of Health shall provide administrative support to the council.
The council shall be composed of the following members or their senior executive-level designees:
The State Surgeon General;
The Executive Director of the Department of Veterans’ Affairs;
The Secretary of Children and Family Services;
The Secretary of Health Care Administration;
The Secretary of Corrections;
The Attorney General;
The Executive Director of the Correctional Medical Authority;
Two members representing county health departments, one from a small county and one from a large county, appointed by the Governor;
A representative from the Florida Association of Counties;
The Chief Financial Officer;
A representative from the Florida Healthy Kids Corporation;
A representative from a school of public health chosen by the Commissioner of Education;
The Commissioner of Education;
The Secretary of Elderly Affairs; and
The Secretary of Juvenile Justice.
Representatives of the Federal Government may serve without voting rights.
Members of the council who are appointed by the Governor shall serve 2-year terms beginning January 1 through December 31. A member may be removed by the Governor for cause or if such member is absent from three consecutive meetings. Any member appointed to fill a vacancy shall serve for the unexpired term of his or her predecessor.
The council shall annually elect its chair and other officers. The council shall meet at least quarterly or at the call of its chair, at the request of a majority of its membership, or at the request of a department. All actions taken by the council shall be based upon approval by a simple majority.
Members of the council shall be reimbursed for per diem and travel expenses as provided in s. 112.061.
The council’s duties and responsibilities include, but are not limited to, the following:
To develop a mission statement, goals, and plan of action for the identification, collection, standardization, sharing, and coordination of health-related data across federal, state, and local government and private sector entities.
To develop a review process to ensure cooperative planning among agencies that collect or maintain health-related data.
To create ad hoc issue-oriented technical workgroups, on an as-needed basis, to make recommendations to the council.
