SB 1174 by Senator Diaz de la Portilla Responds to Community Concerns
Governor Scott Signs Legislation Today
Tallahassee–Senate Bill 1174, Residential Facilities, by Senator Miguel Diaz de la Portilla (R-Miami) was signed by the Governor today and will become effective on July 1, 2016. The legislation responds to requests from Senator Diaz de la Portilla’s community.
“I appreciate the unanimous support of my Senate colleagues as we work to address an issue that concerns many of my constituents as well as other concerned homeowners and families across our state,” said Senator Diaz de la Portilla. “We want to make certain that all Floridians have access to safe and affordable housing options that meet their needs. This bill strikes the appropriate balance through responsible spacing requirements.”
Senate Bill 1174 requires a radius of 1,200 feet between a community residential home licensed for 7 to 14 residents and a home licensed for 6 or fewer residents which otherwise meets the definition of community residential home. The bill does not impact community residential homes already licensed and in operation prior to July 1, 2016. The bill is not expected to have a fiscal impact on the state.
The bill unanimously passed the Florida Senate on February 23, 2016, the Florida House of Representatives on March 2, 2016, and was signed by the Governor today.
