HB 967: Human Trafficking

GENERAL BILL by Stafford

Human Trafficking; Designates act "Florida Victim's Relief Act"; provides that victim of human trafficking has privilege to refuse to disclose, & to prevent another person from disclosing, confidential communication to human trafficking counselor or trained volunteer; provides for disclosure only with prior written consent of victim; specifies by whom privilege may be claimed; authorizes court to award punitive damages to person who proves by clear & convincing evidence that he or she has been injured due to sex trafficking or human trafficking; provides that defendant has affirmative defense of duress or coercion of offense of human trafficking for which he or she is charged; authorizes person convicted of prostitution to file motion to vacate conviction if participation was result of person having been victim of human trafficking; specifies conditions; provides that person moving to vacate has burden of proof by preponderance of evidence.
