HB 299: Alcohol or Drug Impairment

GENERAL BILL by Rouson

Alcohol or Drug Impairment; Provides that person commits offenses of driving or boating while impaired if driver satisfies specified criteria relating to consumption of alcohol or controlled substances; provides that person commits offense of driving while impaired if person has in blood or urine certain controlled substances in specified circumstances; provides that person is entitled to affirmative defense to offense of driving while impaired if, under certain circumstances, person charged with offense introduced controlled substance into his or her body pursuant to prescription; provides that use of nonprescribed substance does not constitute affirmative defense; provides that legal use alcohol, controlled substances, etc. does not constitute defense against charge of driving while impaired; provides that person commits offense of use of firearm while impaired if person uses firearm & satisfies specified criteria relating to consumption of alcohol or controlled substances; revises amount of alcohol concentration that gives rise to presumption of impairment for purposes of offense.
