HB 67: Credit Counseling Services

GENERAL BILL by Porter ; (CO-INTRODUCERS) Costello

Credit Counseling Services; Requires that debt management & credit counseling services be provided pursuant to debt settlement plan; requires credit counseling agency to make certain disclosures to debtor before debtor consents to payment; prohibits credit counseling agency from making certain misrepresentations to debtor; provides certain conditions that credit counseling agency must meet before receiving payment; provides that debtor may withdraw any account funds placed with credit counseling agency at any time without penalty; authorizes credit counseling agency to hold funds in order to allow funds to accumulate.
