GENERAL BILL by Insurance and Banking Subcommittee ; Civil Justice Subcommittee ; Berman ; (CO-INTRODUCERS) Passidomo

Estates; Provides determination of disposition of real property; authorizes payment of attorney fees & costs from trust assets; requires trustee serve written notice of intent upon qualified beneficiary before payment; requires notice be served in specified manner with specified information; provides qualified beneficiaries are entitled to refund of payment; requires award of attorney fees & costs in; prohibits trustee from using trust assets for payment; authorizes order compelling return of attorney fees & costs to trust with interest; requires court deny motion unless was breach of trust; authorizes court to deny motion; authorizes movant to show that reasonable basis exists & trustee to rebut showing; imposes remedies or sanctions; authorizes trustee use trust assets in specified manner; specifies proceedings, remedies, & rights are not limited.
