moved the following amendment:

Section: 02              EXPLANATION:

On Page: 031             Requires public broadcasting stations that have excess
                         capacity on towers they own to share that capacity with
Spec App:  119           state and state-supported private educational agencies.
                         Any public television station migrating to digital
                         service is required to dedicate at least one digital
                         channel 24 hours a day and 7 days a week to Department
                         of Education programming.

        Insert the following new paragraph of proviso for 
        Specific Appropriation 119 on page 31:

Funds in Specific Appropriation 119 shall only be available for grants
to a recipient entity that is willing to permit a public education
entity, including but not limited to pre-kindergarten, kindergarten
through grade 12, community college or state university, or
state-supported private not-for-profit postsecondary institution to use
excess capacity on any tower it owns provided that the applicable
education entity or state-supported not-for-profit postsecondary
institution agrees to pay any costs attributable to such use, the
proposed use will not interfere with existing uses of the tower, and the
design capacity of the tower will not be jeopardized. In addition, if
the recipient entity operates a public television station that is

migrating to digital broadcasting, such entity must dedicate at least
one digital channel 24 hours a day, 7 days a week to the Department of
Education for programming it deems appropriate for at least 10 years.
The Department may negotiate more digital channels for a shorter daily
operating period if it determines such terms are in the best interests
of education.

Funds in Specific Appropriation 10D shall only be available for grants

Line item amendments are accepted as part of the amendatory process. However, due to the necessity of using computerized systems this may entail a different placement within a budget entity or the renumbering of the specific appropriation items.
