1216.1366 Contract terms.
(1) In order to preserve the interest of the state in the prudent expenditure of state funds, each public agency contract for services entered into or amended on or after July 1, 2020, shall authorize the public agency to inspect the:
(a) Financial records, papers, and documents of the contractor that are directly related to the performance of the contract or the expenditure of state funds.
(b) Programmatic records, papers, and documents of the contractor which the public agency determines are necessary to monitor the performance of the contract or to ensure that the terms of the contract are being met.
(2) The contract shall require the contractor to provide such records, papers, and documents requested by the public agency within 10 business days after the request is made.

A. Section 65, ch. 2021-37, reenacted and amended s. 216.1366 “[i]n order to implement the appropriation of funds in the special categories, contracted services, and expenses categories of the 2021-2022 General Appropriations Act.”

B. Section 76, ch. 2021-37, provides that “[i]f any other act passed during the 2021 Regular Session of the Legislature contains a provision that is substantively the same as a provision in this act, but that removes or is otherwise not subject to the future repeal applied to such provision by this act, the Legislature intends that the provision in the other act takes precedence and continues to operate, notwithstanding the future repeal provided by this act.” Section 65, ch. 2021-37, reenacted and amended s. 216.1366 solely to change the July 1, 2021, expiration date to July 1, 2022. Section 1, ch. 2021-225, reenacted and amended s. 216.1366 solely to delete the expiration provision and did not include a new repeal provision.
