CS/HB 1395: Bail Bonds

GENERAL BILL by Insurance and Banking Subcommittee ; Nelson

Bail Bonds; Prohibits transmittal of electronic bonds by unlicensed individuals; allows licensed bail bond agents to electronically transmit bonds in county in which agency is located in certain circumstances; provides for multiple forms of powers of attorney; prohibits bail bond agents from authorizing countersignatures to bonds or powers of attorney; provides that forms for electronic transmittal of bonds may not be furnished to unlicensed individuals; provides for justification of suretyship of bond agents by inclusion of original power of attorney or by initiating electronic transmission of executed power of attorney; provides that money orders & cashier's checks cannot be used to secure more than one bond; allows two or more qualified sureties to each post portions of bond amount; provides for sheriff to select whether to accept electronic bonds in certain circumstances.
