HB 7101: Sentencing for Capital Felonies

GENERAL BILL by Criminal Justice Subcommittee ; Trujillo ; Spano ; (CO-INTRODUCERS) Avila ; Mayfield ; McBurney ; Passidomo

Sentencing for Capital Felonies; Requiring the prosecutor to give notice to the defendant and to file the notice with the court within a certain timeframe if the prosecutor intends to seek the death penalty; requiring juries to determine the existence of aggravating factors, if any, in the penalty phase of capital cases; requiring a certain determination by at least 10 jurors to support a recommendation of a sentence of death; deleting provisions relating to advisory sentencing by juries and findings by the court in support of sentences of death, etc.
