585.715  Enforcement; rules; duties of state attorneys.--

(1)  This part shall be enforced by the department.

(2)  The department shall adopt rules to carry out the provisions of this part, including, but not limited to, establishing standards of identity or composition of specified animal products, identifying exemptions from label requirements, establishing supplemental requirements for a grant of inspection, specifying duties for conducting inspections, and regulating the slaughter of nontraditional livestock.

(3)  The department may request the state attorney in any circuit to bring an appropriate civil or criminal action for the purpose of enforcing this part and the rules of the department, or preventing violation thereof. Any person charged with any duty under this part may be compelled to do the same by mandamus, injunction, or other extraordinary remedy upon the application and in the name of the department. Injunction shall issue without bond. However, criminal penalties may not be imposed against any person for a violation of a rule.
