585.83  Inspection service; prohibition against gifts.--

(1)  The department shall provide inspection service at each establishment which is covered by a grant of inspection. An inspector must be present when animals are slaughtered, and inspections shall be conducted at other times when the establishment is operating.

(2)  Each establishment must maintain adequate security and safety measures for department employees who are providing inspection services. Such measures may include, but are not limited to, lighted parking areas and law enforcement escort to and from the establishment, if the department considers physical safety a concern.

(3)  Each establishment that is covered by a grant of inspection from the department must submit a proposed schedule of operation for approval by the department. The department shall compare the proposed schedule with the schedules of the inspectors and may require that an establishment alter its hours of operation to accommodate the inspectors.

(4)(a)  An establishment requiring overtime or holiday inspection service shall reimburse the department for the costs of the salaries and expenses at the rate prescribed by rule for such service. Overtime inspection service means service rendered during hours in addition to those on the schedule of operation as approved by the department, and holiday inspection service means service provided during any official state holiday listed in s. 110.117.

(b)  Payment for overtime or holiday inspection service is required upon receipt of the invoice and becomes delinquent 30 days after the date of the invoice.

(5)  It is unlawful for any representative of an establishment to give or offer to give, directly or indirectly, to any employee of the department, anything of value, monetary or otherwise, with intent to influence such employee in the discharge of her or his duties under this part.
