Federal grants; maximization of indirect cost allowance.
11010.05 Federal grants; maximization of indirect cost allowance.--The Department of Education shall maximize the available federal indirect cost allowed on all federal grants. Beginning with the 2003-2004 fiscal year, none of the funds received from indirect cost allowance shall be expended by the department without specific appropriation by the Legislature. Funds received pursuant to s. 1004.22 are specifically exempt from this provision.

A. Section 4, ch. 2002-402, amended s. 236.7011 [s. 1010.05] "[i]n order to implement Specific Appropriations 71-166R of the 2002-2003 General Appropriations Act." Some appropriations within this range were vetoed. See ch. 2002-394, the 2002-2003 General Appropriations Act.
B. Section 79, ch. 2002-402, provides that "[a] section of this act that implements a specific appropriation or specifically identified proviso language in the 2002-2003 General Appropriations Act is void if the specific appropriation or specifically identified proviso language is vetoed. A section of this act that implements more than one specific appropriation or more than one portion of specifically identified proviso language in the 2002-2003 General Appropriations Act is void if all the specific appropriations or portions of specifically identified proviso language are vetoed." Not all specific appropriations or portions of specifically identified proviso language relating to the amendment of s. 236.7011 [s. 1010.05] were vetoed. The amendment to s. 236.7011 by s. 4, ch. 2002-402, was added to its successor provision, s. 1010.05, pursuant to the directive in s. 1059, ch. 2002-387.
